Agreement to Terms

By downloading, installing, or using Dew (“the app,” “we,” “our,” or “us”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the app.

These Terms constitute a legally binding agreement between you and Eric Tamez (“Company”).


Description of Service

Dew is a mobile application that helps you track daily habits and practices. The app provides:

User Eligibility

You must be at least 13 years old to use this app. By using Dew, you represent that you meet this age requirement.

If you are under 18, you represent that you have your parent or guardian’s permission to use the app.


User Accounts

Dew does not require user accounts. There is no registration, login, or password. Your data is stored locally on your device.

You are responsible for maintaining the security of your device and any backups.


Acceptable Use

You agree to use Dew only for lawful purposes and in accordance with these Terms. You agree NOT to:


Intellectual Property

Our Intellectual Property

The app, including its design, code, graphics, user interface, and content, is owned by Eric Tamez and protected by copyright, trademark, and other intellectual property laws.

The name “Dew,” the app icon, and associated branding are trademarks of Eric Tamez.

Your Content

Any habits, notes, or data you create within the app remain your property. We do not claim ownership of your content.

By using the app, you grant us no rights to your content because your content stays on your device and we have no access to it.

Open Source and Third-Party Licenses

The app may include open-source software components subject to their own licenses. A list of third-party licenses is available within the app under Settings → About → Licenses.


Premium Features and Purchases

Dew Pro Subscription

Dew offers optional premium features (“Dew Pro”) available through in-app purchase:

Payment Processing

All purchases are processed through the Apple App Store (iOS) or Google Play Store (Android). By making a purchase, you agree to the terms and conditions of the respective platform.

We do not directly handle payment information. All billing inquiries should be directed to Apple or Google, depending on your platform.

Subscription Terms

Auto-Renewal: Monthly and annual subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.

Cancellation: You may cancel your subscription at any time through your account settings on the platform where you purchased:

Cancellation takes effect at the end of the current billing period.

No Partial Refunds: If you cancel mid-period, you retain access until the end of that period but will not receive a partial refund.

Refunds

Refund requests must be submitted to the platform where the purchase was made, as they handle all billing:

Lifetime Purchase

The lifetime purchase grants access to Dew Pro features for the lifetime of the product. “Lifetime” refers to the useful life of the app, not your lifetime. If we discontinue the app entirely, lifetime purchases will not be refunded, but you will retain access as long as the app functions on your device.

Price Changes

We reserve the right to change subscription prices. Existing subscribers will be notified before price changes affect their renewal.


Disclaimers

“As Is” Basis

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

No Professional Advice

Dew is a personal productivity tool. It is NOT:

Habit Tracking Limitations

We do not guarantee that using the app will help you build habits, improve your life, or achieve any particular outcome. Results depend entirely on your own effort and circumstances.

Data Loss

We are not responsible for any loss of data due to:

You are responsible for backing up your device. Dew Pro subscribers can use iCloud sync to keep data across devices, but this is not a guaranteed backup solution.


Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

Eric Tamez, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY:

ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $50, WHICHEVER IS GREATER.

SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR LIABILITY, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

You agree to indemnify, defend, and hold harmless Eric Tamez and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from:


Termination

By You

You may stop using the app at any time by deleting it from your device. No notice to us is required.

We reserve the right to terminate or suspend your access to the app at any time, without notice, for conduct that we believe:

Effect of Termination

Upon termination, your right to use the app ceases immediately. Sections of these Terms that by their nature should survive (such as Disclaimers, Limitation of Liability, and Governing Law) will survive termination.


Changes to the App

We may modify, suspend, or discontinue the app (or any part of it) at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation.

Governing Law and Disputes

Governing Law

These Terms are governed by the laws of the State of Utah, United States, without regard to conflict of law principles.

Dispute Resolution

Any dispute arising from these Terms or your use of the app shall be resolved as follows:

  1. Informal Resolution: Contact us first at dewhabbitapp@gmail.com. We will attempt to resolve the dispute informally within 30 days.

  2. Binding Arbitration: If informal resolution fails, disputes shall be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. Arbitration shall take place in Salt Lake City, Utah, or remotely at your election.

  3. Class Action Waiver: You agree to resolve disputes individually and waive any right to participate in class actions or class arbitrations.

  4. Small Claims Exception: Either party may bring claims in small claims court if eligible.

Exceptions

Nothing in this section prevents either party from seeking injunctive relief in court for intellectual property violations or other urgent matters.


General Provisions

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the app.

Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect.

Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right or provision.

Assignment

You may not assign your rights under these Terms. We may assign our rights without restriction.

Apple-Specific Terms

If you downloaded Dew from the Apple App Store, the following additional terms apply:

  1. Acknowledgment: You acknowledge that these Terms are between you and Eric Tamez only, not with Apple. Apple is not responsible for the app or its content.

  2. Scope of License: The license granted to you is limited to a non-transferable license to use the app on Apple-branded products you own or control, as permitted by the App Store Terms of Service.

  3. Maintenance and Support: Eric Tamez is solely responsible for providing maintenance and support for the app. Apple has no obligation to provide any maintenance or support.

  4. Warranty: Apple has no warranty obligation. Any claims related to the app’s failure to conform to any warranty are Eric Tamez’s responsibility.

  5. Product Claims: Eric Tamez, not Apple, is responsible for addressing any claims relating to the app, including product liability claims, regulatory compliance claims, and consumer protection claims.

  6. Intellectual Property: In the event of any third-party intellectual property claim, Eric Tamez, not Apple, is responsible for investigation, defense, settlement, and discharge.

  7. Third-Party Beneficiary: Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance, Apple has the right to enforce these Terms against you.

Google Play-Specific Terms

If you downloaded Dew from the Google Play Store, the following additional terms apply:

  1. Acknowledgment: You acknowledge that these Terms are between you and Eric Tamez only, not with Google. Google is not responsible for the app or its content.

  2. Scope of License: The license granted to you is limited to a non-transferable license to use the app on Android devices you own or control, as permitted by the Google Play Terms of Service.

  3. Maintenance and Support: Eric Tamez is solely responsible for providing maintenance and support for the app. Google has no obligation to provide any maintenance or support.
